Judge dismisses Blake Lively's sexual harassment claims against Justin Baldoni

A federal judge in New York tossed out actor Blake Lively'ssexual harassment claimsThursday against actor Justin Baldoni over their roles in the movie "It Ends With Us," but he left intact two retaliation claims, which will let a jury hear many of the allegations anyway.

The 152-page ruling by Judge Lewis J. Liman in Manhattan came after Lively sued Baldoni in December 2024, alleging sexual harassment among more than a dozen claims against Baldoni and other parties.

A trial is scheduled to start on May 18. A brief phone conference was conducted after Liman issued his ruling. On the call, lawyers discussed the process of jury selection for the trial.

Baldoni, who directed the movie and co-starred opposite Lively, has denied the sexual harassment claims.

Baldoni and his production company Wayfarer Studios had countersued for $400 million against Lively and her husband, "Deadpool" actor Ryan Reynolds, accusing them of defamation and extortion. The judgedismissed Baldoni's claimslast June.

In his ruling, Liman determined that Lively was an independent contractor rather than an employee. On that basis, he said she was not entitled to bring sexual harassment claims under Title VII of the Civil Rights Act of 1964. That law prohibits employment discrimination on various grounds, including gender.

In an analysis of the sexual harassment claims, the judge said Lively's claims had to be viewed in the context of the movie they were working on.

"Lively claims that during filming, Baldoni leaned in and gestured as if he was intending to kiss her, and that he kissed her forehead, rubbed his face and mouth against her neck, put his thumb to her mouth and flicked her lower lip, caressed her, and leaned into her neck, saying 'it smells good,'" the judge wrote.

He said there was no question that the conduct would support a hostile work environment claim if it happened on a factory floor or in an executive suite.

However, the judge noted, Baldoni was "acting in the scene."

"Assuming he was improvising, the conduct was not so far beyond what might reasonably be expected to take place between two characters during a slow dancing scene such that an inference of hostile treatment on the basis of sex would arise. At least in isolation, the conduct was directed to Lively's character rather than to Lively herself," he wrote.

"Creative artists, no less than comedy room writers, must have some amount of space to experiment within the bounds of an agreed script without fear of being held liable for sexual harassment," Liman added.

Despite those findings, the judge said some sexual harassment claims may be put to a jury to support two retaliation claims that survived the ruling, including one against It Ends With Us Movie LLC and Wayfarer Studios, and a third claim that was left intact, alleging breach of a contract rider agreement against It Ends With Us Movie LLC.

The judge noted that Baldoni once said "pretty hot" after asking Lively to remove her jacket, exposing a lace bra underneath, and that when he was warned that it was inappropriate and distracting to make such comment, he allegedly rolled his eyes and responded: "Sorry, I missed the sexual harassment training."

Liman also cited a scene in which Baldoni pushed for Lively to perform a birth scene naked and then the scene was filmed over several hours without the set being closed to nonessential personnel.

Attorneys for Baldoni said in a statement to CBS News that they're "very pleased" the court dismissed the sexual harassment claims, stating they were "very serious allegations."

"What's left is a significantly narrowed case, and we look forward to presenting our defense to the remaining claims in court," attorneys Alexandra Shapiro and Jonathan Bach said in a statement.

An attorney for Lively said in a statement to CBS News that the case "has always been and will remain focused on the devastating retaliation and the extraordinary steps the defendants took to destroy Blake Lively's reputation because she stood up for safety on the set and that is the case that is going to trial."

"For Blake Lively, the greatest measure of justice is that the people and the playbook behind these coordinated digital attacks have been exposed and are already being held accountable by other women they've targeted," said Sigrid McCawley, an attorney for Lively. "She looks forward to testifying at trial and continuing to shine a light on this vicious form of online retaliation so that it becomes easier to detect and fight."

In February 2025, Livelyalleged in an amended complaintthat Baldoni made other women uncomfortable on the set of "It Ends with Us."

"It Ends With Us," an adaptation of Colleen Hoover's bestselling 2016 novel that begins as a romance but takes a dark turn into domestic violence, wasreleased in August 2024, exceeding box office expectations with a $50 million debut. But the movie's release was shrouded by speculation over discord between Lively and Baldoni.

Lively appeared in the 2005 film "The Sisterhood of the Traveling Pants" and the TV series "Gossip Girl" from 2007 to 2012 before starring in films including "The Town" and "The Shallows."

Baldoni starred in the TV comedy "Jane the Virgin," directed the 2019 film "Five Feet Apart" and wrote "Man Enough," a book challenging traditional notions of masculinity.

USA TODAY Cyclist Moriah Wilson, who died in 2022, is the subject of Netflix's documentary, "The Truth and Tragedy of Moriah Wilson."

May marks four years since accomplished 25-year-old cyclist Anna Moriah Wilson, known affectionately as "Mo," was murdered byKaitlin Armstrong. Armstrong worried that something simmered between Moriah and her longtime boyfriend Colin Strickland, whom Armstrong lived with. Moriah and Strickland had a short romance in the fall of 2021, when Armstrong and Strickland were on a brief break. Moriah's parents say when Moriah returned to Austin for a bike race the following spring, she and Strickland were only friends. But a jealous Armstrong shot and killed Moriah on May 11, 2022. The events are chronicled inNetflix's documentary, "The Truth and Tragedy of Moriah Wilson"(now streaming).

"The first thing I did, when the officer told me she had died, was I screamed up into the sky to God, and I said, 'You are going to do something good with this,'" Karen recalls.

Filmmakers had approached Wilson and husband Eric about movie ideas, Wilson says, but nothing felt right until they met with Oscar-winning producer Evan Hayes ("Free Solo"). Wilson says when Hayes shared how Moriah lived "could be a positive influence on his daughter" Wilson thought "OK, if that's what you're really looking for, that's awesome."

The documentary captures Moriah's dedication to racing and zest for life, as recalled in interviews with her family, friends and an ex-boyfriend.

"For years, at the end of every day, she would write out what she wanted to try to accomplish the next day," Eric tells USA TODAY of his daughter, "and the three things she was thankful for."

The details of her death and recalled by members of law enforcement. "The district attorneys, the police officers, everyone was so invested in this story," says director Marina Zenovich ("I'm Chevy Chase and You're Not,""Lance"). "I felt like Austin really rallied as a city to try to bring justice for Mo."

Hearing the Wilsons talk about their child moved the crew from their very first day of filming, Zenovich says. They filmed the pair walking in their garden where a plaque honoring Moriah's life rests.

"It was like my whole crew was crying, and I'm talking about grown men," Zenovich says. "It was like, 'Oh wow this is something. This is something deeply, deeply emotional.'"

The film begins with home movies capturing Moriah's early years. "It was as if I always had known her. It was so familiar," Wilson says in the documentary, her voice beginning to crack. And just days after Moriah's birth, on May 18, 1996, Wilson was hit with the heartbreaking notion that Moriah would leave her someday. At the time, Wilson envisioned an adult Moriah simply moving out of the house or getting married. "But then after she died, when I thought back about that − because it was so powerful, the emotion, I was sobbing and sobbing − it was like I was mourning," she tells USA TODAY.

The day ofMoriah's death, she and Strickland went swimming and for a bite to eat, before he returned Moriah to her friend's apartment where she was staying around 8:30 p.m.,according to reports. Armstrong fired the first shots around 9:15 p.m.

"The Truth and Tragedy of Moriah Wilson" shows how investigators pieced together the case andarrested Armstrongin Costa Rica after a 43-day hunt. She used her sister, Christine Armstrong's passport to leave the States. (According to NBC News, Christine had not been charged with a crime.) Kaitlin Armstrong wasconvicted of first-degree murderand sentenced to 90 years.

Zenovich says she reached out toArmstrongin prison and her sister about the documentary that premiered at Austin'sSouth by Southwest (SXSW)in March, but didn't hear back from either. Strickland agreed to be filmed, Zenovich says but not interviewed. "But I think how he looks and his demeanor really speaks to what this did to him," she says.

Viewers have expressed appreciation to the Wilsons "for sharing her life because they felt like they really got to know her," Karen Wilson says. "And as a mom, I've come to the conclusion that one of the reasons [I'm] so happy that this film is made is that she's remembered. People die, they get forgotten and sometimes you never really talk much about them because it's painful or whatever. But I love talking about her, and it keeps her in our life."

Moriah's legacy is also continued throughthe Moriah Wilson Foundation, which annually hosts the "Ride For Mo" event, happening this year on May 9.

The foundation is "a good place to put our energy rather than sitting around moping about being sad," Wilson says. "There's definitely those moments, and there will always be those moments, but we've just got to live life. She wants us to live life."

US targets Chinese chipmaking with proposed export restrictions on ASML and others

AMSTERDAM, April 3 (Reuters) - A cross-party group of U.S. politicians have proposed a law to impose further restrictions on ‌exports of computer chipmaking equipment to China, affecting companies such as ‌ASML and China's top chipmakers.

The draft MATCH Act announced late on Thursday is aimed at ​protecting the U.S. lead inartificial intelligenceby preventing Chinese companies from obtaining chip manufacturing tools they cannot make themselves and ensuring that companies based in U.S.-allied nations face the same restrictions as their U.S. rivals.

The U.S. ‌has previously introduced several rounds ⁠of export restrictions aimed at curbing China's chipmaking capability, but those were led by President Donald Trump or President ⁠Joe Biden rather than Congress.

Lawmakers said their focus was on restricting technologies where China relies on imports, such as immersion DUV lithography needed to create chip ​circuitry. ​This market segment is dominated by the ​Netherlands' ASML, competing with smaller ‌Japanese rival Nikon.

The proposed law would also prevent the sale or servicing of such equipment to leading Chinese chipmakers SMIC, Hua Hong, Huawei, CXMT and YMTC.

ASML declined to comment on Friday.

Existing rules coordinated with the U.S. and enforced by the Dutch government block ASML from sending its most advanced ‌tools to China. However, ASML still sells ​older DUV lines to Chinese chipmakers and ​to leading South Korean and ​Taiwanese companies with operations in China. The new law ‌would prohibit that.

China was ASML's largest ​market in 2025, accounting ​for 33% of sales. That figure is expected to drop to 20% this year, it said in January.

"It is not our place ​to comment on draft ‌legislation proposed by lawmakers from other countries," said a spokesperson ​from the Netherlands' foreign ministry, which oversees trade and export policy.

A 45-year-old construction worker and father of three has died after falling approximately 60 feet at a job site in Wichita, Kan., according to local reports.

David Rodriguez was working at the Bio-Med building near English Street and Topeka Avenue, a few blocks west of INTRUST Bank Arena, when the incident occurred around 11 a.m. local time on March 30,12 Newsreported.

The first responding crew began patient care upon arrival, and Rodriguez was considered in critical condition because of how far he fell, Wichita Fire Department Battalion Chief Jose Ocadiz toldKAKE.

Rodriguez later died from his injuries.

Midwest Drywall confirmed in a statement to KAKE, 12 News andThe Wichita Eaglethat one of its employees had died following the incident.

"Midwest Drywall is heartbroken to confirm that a member of our team passed away following an incident today at a construction site in downtown Wichita," Midwest Drywall's statement read. "Our prayers and deepest sympathies are with the individual's family, friends, and teammates during this difficult time. The site has been secured, and work has been temporarily suspended while the incident is reviewed."

Rodriguez is survived by his wife, Rosemary, and their three children, ages 9, 8 and 6. In a postshared to Facebook, the nonprofit League 42 described him as a "hard worker and devoted family man," noting that all three of his children play baseball for the organization.

"We offer our deepest condolences to David's family and friends," the group said in part.

AGoFundMe campaigncreated on behalf of Rodriguez's family describes him as "one of the hardest workers" who "lived to serve his friends and family."

"I will always remember David as genuine, kind, and funny, he always was making his friends laugh and was definitely the life of the party, he always lit up every room he walked into," the fundraiser reads.

The campaign has raised over $27,000 of its $40,000 goal so far. It aims to help cover funeral and living expenses for his family as they grieve.

The Occupational Safety and Health Administration (OSHA) is investigating Rodriguez's death, 12 News reported.

The train was en route from Cologne to Frankfurt on Thursday evening. It was evacuated in Siegburg, not far from Cologne, and federal police said the man was restrained and arrested, German news agency dpa reported. They said he had a knife in his backpack.

The man had shut himself in a bathroom on the train, according to police. German newspaper Bild reported that the firecrackers were thrown into an aisle. Police said several people sustained superficial flesh wounds.

There was no immediate information on the suspect.

Bruce Hornsbywasn't planning to write a new album. Or even new songs.

After a nearly seven-year span from 2019, when he'd written more than 40 compositions for four records and collaborated with New York chamber sextetyMusic, Bon Iver frontmanJustin Vernonand Shins founderJames Mercer, he was, admittedly, burned out.

Then the "germ of an idea" for what would become the title track to his new album,"Indigo Park,"out now, infiltrated his brain.

"I was giving it the stiff arm for months and months," Hornsby, 71, says, chatting from the wood-paneled studio at his longtime scenic home in Williamsburg, Virginia ("My next move is into a pine box," he jokes).

But he couldn't quash the burgeoning song concept.

In addition to acknowledging the 40th anniversary of his biggest commercial hit, "The Way it Is," Bruce Hornsby releases the album "Indigo Park" April 3, 2026.

"It would wake me up in the middle of the night so I finally said, 'OK, I will take this deep dive and write the song'," Hornsby says. "A lot of this record could be called myRoger McGuinnrecord because the Rickenbacker 12-string is in full force."

Indeed, though Hornsby'sheady musicianship as a pianistis well-documented, he's also playing the electric 12-string guitar on the first five songs of what he calls "a pretty wild record."

Amusical adventureis expected from an artist who broke into the mainstream in 1986 with the philosophical jazz-pop smash"The Way It Is"(hardly typical MTV fodder), cowrote and played on Don Henley's"The End of the Innocence,"toured for a couple of years with The Grateful Dead, composed numerous scores for Spike Lee's films and worked with artists including Chaka Khan, Stevie Nicks, Robbie Robertson and Bonnie Raitt.

The latter adds to the electronic-spiked, beat-propelled"Ecstatic,"while Vampire Weekend's Ezra Koenig guests on the sprightly "Memory Palace" and late Grateful Dead stalwart Bob Weir adds his unconventional style to "Might As Well Be Me, Florinda."

The cerebral Hornsby – who willtour most of the yearstarting April 9 with his band The Noisemakers – delved into how "The Way It Is" still resonates, working with Weir and Raitt on"Indigo Park", and why hallway-walking is his fallback exercise.

Question: Before we talk about the new album, it's the 40thanniversary of "The Way It Is." When you wrote the lyrics"some things will never change," what were you thinking about?

Bruce Hornsby: I was just reflecting on my upbringing, growing up in a small, Upper South Town where those narrow-minded attitudes prevailed. That's how I grew up. It's referenced in a sort of interesting way on this new record on "Silhouette Shadows," which is a look-back song. The last verse is about where I was and what happened when Kennedy was assassinated. (Recites lyrics) "The kids erupted in glee/shouting 'Hooray, Nixon can take over'/Ms. Nimmo jumped their ass and tore 'em down/I was really alarmed and confused/watching the children parroting parents' views." And that was sort of Exhibit A of the pervasive mindset in Williamsburg, Virginia, at that time and "The Way It Is" is sort of another version of that.

And the song has lived on.

It seems to be a song set up for the ages, and that's lucky me. The hip-hop community's embrace of ("The Way It Is") plays no small part. Tupac's is of course the most notable(1998's "Changes"). But hell, in 2021, the great Chicago young rapper, Polo G, did an amazing version called"Wishing for a Hero."It was basically his homage to Tupac, but then (laughs), it's my song. But he had a beautiful gospel choir. So it's still being sort of refreshed in that way.

Is it the one song you can't take out of your set list?

Well, occasionally I won't do it. And the reason I won't do it is that we're up there and the place is so deeply involved and so intensely demonstrative about (the music) that I go, well, you know, we don't need to play this tonight because (the audience) is so ready to receive what we're doing now. But invariably I'll get a nasty Facebook or Instagram screed from some fan, quote, unquote, who's not really a fan, but …

He knows your hits.

Exactly. I understand that. But I'm not going to be a prisoner to that idea, that I have to be that guy who plays those old songs. I could never do that. I'd rather teach driver's ed than do that.

What's the backstory on getting Bob Weir on "Might As Well Be Me, Florinda"?

I ran into him at theRobbie Robertson tribute concertat The Forum in Los Angeles (in October 2024) a few months after he had passed. It was a wonderful night and we were hanging out in this bus and I thought, "hmm, this might be a good match, Bobby and this song." So I told him I had this song I wrote with (longtime Grateful Dead collaborator Robert Hunter) and if you hear yourself singing on it, great. He went, "Send it to me. Yeah, maybe. Oh, forget it, I'm in." It was so funny, so great. We finally got it to him in May last year and he sent us this wild vocal. His vocal is crazy.

It's so him.

It really was just perfect. And that was really lucky. You never know when you ask somebody to perform for you what it will be like when you get it back … We called and gave him all the laudatory remarks and then he went off to do the Dead & CompanyGolden Gate Park concerts. I was hearing little rumblings about some health challenges that he was dealing with, then I didn't hear anything else and all of a sudden, wham, in January, I get the call abouthis passing. That stuff hits hard because you're not expecting it. So I feel fortunate and so happy we have this last little recorded document that might be the last thing he recorded.

It's also great to hear Bonnie Raitt's voice on "Ecstatic." You played on her"I Can't Make You Love Me,"and the last time you were on record together was for your 1993 "Harbor Lights" album. Why was this the ideal song for her?

I thought that it wasnot her standard wheelhouse. Stylistically, it's not a bluesy thing. I did give her one blues thing and she said, "Hey, thanks, at least I've gone this one thing where I can lay into a blues note." (Hornsby sings) "I'm committed to the unseen" – it's that line. So I thought if she was feeling adventurous that this would be something fun for her. Bonnie, I feel like she's my big sister in music. We've been so close. We'll get on the phone and talk for an hour, often.

Let's talk about the upcoming tour. You've spent so much of your career on the road. Do you still tolerate it well?

I hate it. Well, tolerate, yeah, and here's why. It's 2-2 1/2 hours of playing that is great fun. I always say it's more fun than anything you can do outside of a bed and that's still true. But the other 21 hours, the long bus rides, the overnight rides when you're in the bunk and you're being jostled by the funky road. Who likes that? I mean, Bob Dylan probably likes it (laughs) because he's done this never-ending tour for 20-25-years plus. So that's my conflicted feeling about the road. Love the playing. The rest you can have.

Do you try to get out and go for a walk or do something to break the monotony when you're traveling?

I have my routine and it includes a walk. I'm also good at hall walking when it's terrible weather.

You mentioned that you also do that at home when it's too cold to go outside.

Yeah, although in my house I don't have maids looking at me going, who is this tall, goofy guy who keeps passing by?
